These Terms of Service ("Terms") govern your use of the Kintact mobile application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Questions: hello@getkintact.app.
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.
You are responsible for the accuracy of the information you provide, for maintaining the security of your account credentials, and for all activity under your account. Notify us promptly of any unauthorized use.
You retain ownership of the contacts, notes, dates, photos, and other content you add to the Service ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to operate and improve the Service for you. You are responsible for Your Content, including ensuring you have the right to store the information you add about others. Use the Service only for personal relationship management and in compliance with applicable law.
We may suspend or terminate accounts that violate these Terms.
Our Privacy Policy explains how we collect and use information and is incorporated into these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST. YOU ARE ENCOURAGED TO KEEP INDEPENDENT RECORDS OF IMPORTANT INFORMATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINTACT AND ITS CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You may stop using the Service and delete your account at any time in the app's settings or by contacting us. We may suspend or terminate the Service or your access to it for violations of these Terms or if we discontinue the Service, with reasonable notice where practicable.
We may modify the Service and these Terms. If we make material changes to the Terms, we will update the effective date above and, where appropriate, notify you in the app. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.
